Parking

This DA does not comply to 29/2/e of Affordable Rental Housing

State Environmental Planning Policy (Affordable Rental Housing) 2009 wrote:

(e)  parking
if:
(i)  in the case of development carried out by or on behalf of a social housing provider in an accessible area—at least 0.2 parking spaces are provided for each boarding room, and
(ii)  in the case of development carried out by or on behalf of a social housing provider not in an accessible area—at least 0.4 parking spaces are provided for each boarding room, and
(iia)  in the case of development not carried out by or on behalf of a social housing provider—at least 0.5 parking spaces are provided for each boarding room, and
(iii)  in the case of any development—not more than 1 parking space is provided for each person employed in connection with the development and who is resident on site,

I believe this means 2.4 or 3 car spaces should be provided.

As this  boarding house is not supplied by a social housing provider, then 4.5 or 5 car spaces should be required.  This is (e)(iia), (e)(i) does not apply unless the DA is on behave of social housing provider.  The DA did not mention (e)(iia) when referring to the planning policy.

This DA also refers to the City of Sydney Boarding Houses DCP 2004. 2.8 Car parking c) Parking Exemptions.  Written prior to this planning policy, but still DCP says

City of Sydney Boarding Houses DCP 2004: 2.8 b) Off Street ParkingRequirements wrote:

Off-street parking shall be provided in accordance with the requirements of the relevant LEP or DCP (as applicable).

City of Sydney Boarding Houses DCP 2004: 2.8 c)  Parking Exemptions wrote:

In certain circumstances, and dependent upon the size of the proposed Boarding House Council may consider parking provision less than that specified above based on the following:
(a) traffic and on-street parking within the street is such that parking is not required and can be adequately catered for on-street;

Other than the DA applicant, you will have a hard time convincing the local residents there is adequate on=street parking.
This DCP also refers Class 1b Boarding Houses a smaller scale, which might be applicable to this exemption, but Class 1b has 12 or less permitted number of persons. This application has a maximum of 16 persons, 33% larger than a Class 1b boarding house.   

This DA supplies no car parking.  It tries to explain this away in the Statement of Environmental Effects & Heritage Impact this non-compliance by supplying bicycle and motorcycle parking.  This is irrelevant is they are also required as part of this planning act.
It also says it unnecessary because it is in an accessible area. Also irrelevant since this is part of the calculation of parking spots.
This DA does claims there :

There is ample parking on street and as such is able to cater for more parallel street parking.

Again, I would believe any survey of this area would show it very difficult to find a park on week night evenings.

With the new application, they need to supply 4 parking places (8 rooms by 0.5 cars)
